Welcome to IELTS LEVEL UP ("Company," "we," "us," "our," or "Platform"). These Terms of Service ("Terms") govern your access to and use of our website, mobile application, and all associated services (collectively, the "Service"). By accessing, browsing, or using the Service in any manner, you agree to be bound by these Terms.
If you do not agree to all of the Terms, do not use the Service. We reserve the right to modify these Terms at any time. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the modifications.
2. Definitions
"User" means any individual who accesses or uses the Service, either with or without creating an account.
"Account" means a user account created to access specific features of the Service.
"Content" means all materials available on the Service, including but not limited to text, graphics, images, audio, video, software, practice tests, explanations, reports, and any other information.
"User Content" means any content, data, or information that you submit, upload, or create through the Service.
"Cambridge Materials" means authorized practice materials and test content from Cambridge English (IELTS).
3. User Accounts
3.1 Account Creation
To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current. You are responsible for maintaining the confidentiality of your account credentials and password.
3.2 Age Requirement
The Service is intended for users who are 13 years of age or older. By creating an account, you represent that you are at least 13 years old. If you are under 18, you represent that you have parental or guardian consent to use the Service.
3.3 Account Security
You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not responsible for any loss or damage arising from your failure to protect your account information.
3.4 Account Termination
You may terminate your account at any time by contacting us. Upon termination, your right to use the Service immediately ceases. We may retain certain information as required by law.
4. Intellectual Property Rights
4.1 Ownership
The Service and all content contained therein, including but not limited to text, graphics, logos, images, audio clips, video clips, digital downloads, and data compilation, are the exclusive property of IELTS LEVEL UP or its content suppliers, including Cambridge English. All rights are reserved.
4.2 Cambridge Materials License
We are authorized to use and distribute Cambridge IELTS practice materials through the Service. These materials are the property of Cambridge English and remain protected by international copyright law. Your use of Cambridge materials is limited to personal, non-commercial educational purposes only.
4.3 License Grant
We grant you a limited, non-exclusive, non-transferable license to access and use the Service for lawful purposes. This license does not include the right to: (a) reproduce, copy, or print materials for commercial purposes; (b) distribute, modify, or transmit any content; (c) remove any copyright or proprietary notices.
4.4 Trademarks
"IELTS LEVEL UP," and all related logos, are trademarks or service marks of IELTS LEVEL UP. IELTS is a registered trademark of the University of Cambridge, British Council, and IDP. All other trademarks are the property of their respective owners.
5. Prohibited Conduct
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party right
- Infringe on intellectual property rights, including reproduction or distribution of copyrighted materials
- Engage in harassment, bullying, or abusive behavior toward other users
- Distribute spam, malware, viruses, or malicious code
- Attempt to gain unauthorized access to the Service or its systems
- Reverse engineer, decompile, or disassemble the Service
- Interfere with or disrupt the normal functioning of the Service
- Scrape, crawl, or automatically download content without authorization
- Use the Service for commercial purposes without our express written consent
- Share your account credentials with others or allow others to use your account
- Resell, redistribute, or rent access to the Service or content
- Cheat on tests or use unauthorized materials during assessments
6. User Content License
You retain ownership of any User Content you submit. However, by submitting User Content, you grant us a worldwide, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, and distribute such content for operational and improvement purposes.
You represent and warrant that you own or have all necessary rights to any User Content you submit and that it does not violate any third-party rights or applicable laws.
7. Limitation of Liability
7.1 IELTS Score Predictions
Our AI-generated score predictions and band estimates are for educational and practice purposes only. They are not official IELTS scores and should not be relied upon as accurate predictions of actual IELTS exam results. Actual results may vary significantly based on numerous factors.
7.2 No Warranty
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
7.3 Limitation of Damages
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL IELTS LEVEL UP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7.4 Maximum Liability
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
8. Indemnification
You agree to defend, indemnify, and hold harmless IELTS LEVEL UP and its officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Any User Content you submit
- Your infringement of any third-party rights
9. Termination
9.1 Termination by You
You may terminate your account at any time by submitting a request through the Service or contacting us. Your termination will be effective within 30 days.
9.2 Termination by Us
We may suspend or terminate your access to the Service immediately, without notice, if: (a) you violate these Terms; (b) we believe it necessary to protect the Service or other users; (c) you engage in fraudulent or illegal activity; (d) as required by law.
9.3 Effect of Termination
Upon termination, your right to use the Service immediately ceases. Sections that by their nature should survive termination (such as intellectual property, indemnification, and limitations of liability) shall survive.
10. Disclaimers
10.1 Educational Purposes
The Service is provided for educational and practice purposes only. It is not a substitute for professional IELTS coaching or official IELTS exam preparation. Results, scores, and progress metrics are estimates for practice purposes.
10.2 Cambridge Materials
While we use authorized Cambridge materials, we are not endorsed by or affiliated with Cambridge English, the British Council, or IDP. IELTS is a registered trademark of these organizations.
10.3 Service Availability
We do not warrant that the Service will be uninterrupted or error-free. We may perform maintenance, updates, or make changes that may temporarily affect availability.
11. Governing Law & Dispute Resolution
11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions.
11.2 Dispute Resolution
